We offer a number of visa pathways to enable anyone in a de facto or spousal relationship with:

    • an Eligible New Zealand citizen (which means a New Zealand citizen who settled in Australia pre 26 February 2001), who can sponsor you for an onshore Partner Visa
    • a New Zealand citizen who is not an Eligible New Zealand citizen, eg a Subclass 461 Visa

… to live in Australia with their de facto partner or spouse.

Of course, in Australia this includes same-sex relationships.

There is a lot of confusion when it comes to understanding what an Australian partner visa is. “Australian Partner Visa” is an umbrella term which includes Spouse Visas and De Facto Visas and it is a pathway to Permanent Residence (PR) in Australia.

Adding a partner to a student Visa or 457/TSS visa does not result in PR, but may provide a pathway to PR in the future.

Being granted a NZ Citizen Partner Visa does not provide PR either, but provides ample time to prepare for many other types of visas, that may lead to PR.

Applying for a partner visa in Australia (Subclass 820/801)

When you apply for an Australian partner visa in Australia you apply for a Subclass 820 provisional partner visa combined with a Subclass 801 permanent partner visa.

The Subclass 820 partner visa is a temporary partner visa granted to an applicant who is in an ongoing relationship with their partner, who is an Australian Citizen or Australian Permanent  Resident.

The Subclass 801 partner visa is a permanent partner visa with no conditions and can be held onto even after a relationship breakdown. You are able to lodge an application two years after the date of application for the Temporary Partner Visa.

Hence the reason some people refer to partner visas as 820 visas, visa 820, partner visa 820 or visa subclass 820/801.

Applying for a partner visa from outside Australia (Subclass 309/100)

When applying for an Australian partner visa from outside Australia, applicants must apply for a Subclass 309 provisional partner visa combined with a Subclass 100 permanent partner visa.

The Subclass 309 partner visa is a temporary partner visa conditional on the visa holder continuing in their relationship with their partner.

The Subclass 100 Partner visa is a permanent partner visa without any conditions and endures even if there is a relationship breakdown.

If you are engaged to an Australian citizen,  permanent resident or an Eligible New Zealand citizen you will probably meet the criteria for a subclass 300 Prospective Marriage Visa, often referred to as the fiancé visa. You must be outside Australia when you apply for the visa and outside Australia when the visa is granted.

If you are in a relationship with a New Zealand citizen who moved to Australia after the 26th of February 2001 you will need to apply for  a Subclass 461 New Zealand Citizen Family Relationship visa.

This is a temporary visa which lasts for five years and can be renewed every five years. This applies even if your relationship breaks down, so long as you are not in a new relationship.
